After much effort, your I-485 application to adjust status to permanent resident is finally submitted to USCIS. As you patiently wait for the applications to be reviewed, an emergency came up that requires your presence abroad. Your advance parole application, like the rest, is still pending. Unless you have a dual intent visa like the H-1B or L-1, you also can’t use your nonimmigrant visa to travel unless you’re prepared to abandon the adjustment application. What to do?
In case of medical emergencies, death or severe injury/illness in the family, severe financial loss, or other similarly urgent situations, a noncitizen who is otherwise eligible for an advance parole may request for an emergency advance parole by first setting an in-person appointment with USCIS. They may do so online or by calling 1-800-375-5283.
On the day of the appointment, noncitizen should bring a completed I-131 form, G-28 if represented by an attorney, filing fees, two passport style photos, proof of status in the US, an I-485 receipt notice if applicable, and any documents that support the reason for emergency travel. They will speak to an immigration officer in person to discuss the travel plan. If successful, the advance parole should be issued the same day.
